This visa offers a temporary stay opportunity for children while their parent’s permanent partner visa application is pending. If approved, the children can relocate to Australia and reside with their parents until the permanent partner visa decision is made.
Key Eligibility Criteria:
Children must be reliant on a parent holding a partner provisional subclass 309 visa, partner subclass 820 visa, or dependent child subclass 445 visa. After obtaining the 445 visa, the child should apply to be added to the parent’s partner visa application. Notably, the child should not hold an Australian visa with a no further stay condition.
Children must be sponsored by the same person who sponsored their parent’s partner visa application, subject to departmental approval. Additionally, they should be under 18 years old. If over 18, financial dependency on the parent holding a temporary partner or dependent child visa is required.
Children born to one Australian citizen parent at birth outside Australia can apply for Australian citizenship by descent and do not need to apply for the 445 visa.
